We are upfront about our Service Terms and Conditions. Some providers will lock you into a service for years or even charge you to move away - but we understand that business needs can change. We never charge anything to move from our services once the $99 is paid and the terms below are followed 1) Our package fees are for $99 and include a .com domain name, installation of an e-commerce package and one years web hosting. This domain name is owned by you or your company. When signing up for any of our packages you agree and understand that the $99 fee is non-refundable as the charge is levied by the process of setting the account online and not by any e-commerce software installed, the years hosting or domain name Because the $99 fee is non-refundable we are able to offer you this uniquely non-restrictive agreement. It's important to note that chargebacks or attempts to defraud via PayPal will result in the site and domain name to immediately owned by Let's Build 2) You may, after 90 days, move your site away from our web servers to another hosting provider. There is no restriction to moving your site away once the 90 days are up. This is to ensure all credit card payments are legitimate. Of course, once you move your site away from our servers, we can no longer help you with any support issues 3) The domain name is owned by yourself or your company, and can be sold to any third parties or moved to another domain name registrar at the end of the 12 month contract. Again, this is to ensure all credit card payments are legitimate. It's important to note that at ALL times you or your business own the domain name unless these terms are broken 4) If you decide to stay with us after a year, simply pay just $15 a month to continue with our excellent service. You can also pre-pay for a year for a discounted $150. Please note, however, that these fees are not refundable as per our (1) terms 5) We do not provide custom software work beyond the design of the text-based logo for your website. For the e-commerce package, you are given links to plug ins and support forums to assist you further 6) We can not host, support, design, register a domain or allow any business/person involved in guns/weapons, drugs, warez/pirated software or links, gambling, hate speech/racism, religious intolerance, MP3 downloads that are not your full copyright, firearms or websites containing/selling items of an explicit sexual nature 7) We do not allow you to send bulk e-mail from our servers. If bulk e-mail is sent (for example, thousands of e-mails sent by the minute/hourly/daily) then a warning will be issued and your service suspended 8) Each server has it's bandwidth limits. You are given 300mb space with 2 gig transfer each month. If you go over this amount, you will be notified. No response to this e-mail will mean your account will be suspended - but don't worry, this is highly unusual! 9) As you own your e-commerce website, you are free to sell it. However, the e-commerce cart system remains the property of the authors. The text-based logo is yours to keep. The default shop webdesign itself, unless changed, is still owned by Let's Build and can not be re-used or re-sold without our express permission. 10) You may re-design any element of your store but at all times a link back to the creators of the e-commerce product must be given on your store as per their terms. You can purchase a licence for the software to remove this link back requirement for $69 to remove the link to their website. To see an example of the links required, view our demo store. We would love you to keep linking back to letsbuild.com, but this link can be removed if you wish. 11) Currently we can only offer this exact $99 special to each new customer. However, existing clients can order as many $99 packages that don't come with the domain name as they like. Finally - we endeavor to bring you the best support possible via our e-mail support system and to ensure your site is online 24 hours a day, seven days a week. However, like all electronic services, there may be very rare periods of downtime. You understand and agree you will not be compensated if brief periods of downtime occur. Note: Any breach of these terms and conditions you will be issued with a notice. If we receive no response or resolution within 24 hours, your service will be suspended. If we are still unable to resolve the issues within 5 business days, your account will be cancelled and, as per our terms, no refunds will be given. The full website and domain name then become the property of Let's Build.

Our acceptable use policy.

IT IS IMPORTANT YOU READ THIS AGREEMENT CAREFULLY. WHEN ORDERING OUR SERVICES, YOU AGREE TO BE BOUND BY ALL THE TERMS OF THIS AGREEMENT. ADDITIONALLY, USE OF OUR SERVICES CONSTITUTES ACCEPTANCE OF THIS AGREEMENT. The company "Let's Build!" shall be known throughout this document as "Let's Build". Let's Build agrees to furnish services to the Subscriber, subject to the following Acceptable Use Policy (AUP) and Terms of Service (TOS). Let's Build reserves the right, in its sole discretion, to terminate this Agreement immediately and without prior notice or immediately suspend and/or cancel permanently any and all services provided to the user upon any breach of this Agreement by the user. CONTENT Let's Build does not allow any of the following content to be stored on its servers: Illegal Material - This includes but is not limited to copyrighted works, commercial audio, video, or music files, and material in violation of any Federal, State or Local regulation. Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Let's Build. Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking, IP spoofing, etc., and the encrypting of any of these. Unacceptable sites also include any which provide "links to" or "how to" information about proscribed material as defined above. COPYRIGHTED MATERIAL POLICY If any copyrighted material other than the holder of the account's own is to be stored on a Let's Build server, Let's Build must receive a signed photocopy or original letter giving explicit, specific permission from the copyright holder. HIGH RESOURCE USER POLICY Resources are defined as bandwidth and/or processor utilization. Let's Build may implement the following policy to its sole discretion: When a website is found to be using excessive resources available, Let's Build reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby Let's Build continues hosting the website for an additional fee. PAYMENT POLICIES All accounts are set up on a prepay basis. Although Let's Build reserves the right to change prices of accounts or services at any time, all pricing is guaranteed for the period of prepayment. Payment is due each anniversary of the billing period following the date the account was established. Customers will automatically be invoiced again at the end of their prepay period unless closure request has been made 5-7 business days prior to ending of the prepay period. All cancellation requests must be made through the support desk. In situations where the credit card number on file is declined, Let's Build will make multiple attempts to charge again within the next 7 days. Invoices that are 7 days past due dates will have the account suspended immediately until the outstanding invoice is processed successfully. Overdue invoice(s), if not paid within 10 days of the invoice due date, will have a $10 late fee added to the invoice(s). Accounts which are past due by 30 days are subject to termination of all services provided by Let's Build and will be removed completely from our server(s). Let's Build will make every attempt to notify the client via email. The customer is responsible for all money owed on the account from the time it was established to the time that a written cancellation request is received. CANCELLATION AND REFUNDS Let's Build reserves the right to cancel the service at any time. If a customer contravenes Let's Build terms of service and incurs cancellation, a refund will not be issued after the 30 days period of initial signup. There are no refunds of the $99 e-commerce special. The setting up of the account creates the charge - and not the domain name, years hosting or e-commerce package installation. SPAM OR UNSOLICITED E-MAIL Let's Build takes a zero tolerance approach against UCE and SPAM. - UCE is the term used for Unsolicited Commercial Emails. - SPAM is the term used for Mass Unsolicited Emails. Let's Build strictly prohibits the sending of SPAM and UCE from our servers. Usually these are promotions or advertisements sent in bulk to the email addresses of the people who have not requested this information. Customers found to be in violation of this policy will face severe penalties; Let's Build reserves the right to charge a penalty of up to $500 and permanently cancel any and all services provided to the user. ABUSE Any attempts to undermine, slander, libel, threaten, or cause harm to a Let's Build server, customer, employee, or the company directly/indirectly is strictly prohibited and is grounds for immediate termination without refund. In addition, we will pursue all attempts to the fullest extent of the law. INDEMNIFICATION Customer agrees to defend, indemnify, save and hold Let's Build harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Let's Build, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Let's Build against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Let's Build servers; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to the Customer from a Let's Build server. Customer agrees to limit the liability of Let's Build to the amount paid for service. DISCLAIMER Let's Build will not be responsible for any damages your business may suffer. Let's Build makes no warranties of any kind, expressed or implied, for services we provide. Let's Build disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Let's Build and its employees. Let's Build makes no server "uptime" guarantees. Let's Build performs immediate backups of all servers via mirroring drives. Let's Build can accept no responsibility for any loss of data or consequences arising from this. Let's Build always advises clients to back up their site data regularly for its own protection. Customer hereby represents that he, she or it is either, an individual entering this Agreement for his or her personal use and is over 18 years of age, or a corporation, limited partnership or other legal entity, duly organized, validly existing and in good standing under the laws of the state of its organization and the person acting on behalf of Customer is duly authorized to accept, execute and deliver this Agreement on behalf of Customer. Failure to comply with any of our terms and conditions will result in grounds for immediate account termination. Let's Build reserves the right to change, edit, or update the policies contained in this document at any time for any reason without notice.
